Please read these Terms and Conditions ("Terms") carefully before using the website atlasbackflowtesting.com (the "Site") or engaging Atlas Backflow Testing ("Atlas," "we," "us," or "our") for services. By accessing the Site or requesting, scheduling, or receiving services from us, you ("you," "your," or "Customer") agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Site or our services.

1. About Us

Atlas Backflow LLC (operating as Atlas Backflow Testing) is a limited liability company (LLC) operating in the State of Texas. We provide backflow prevention assembly testing, repair, and installation services for residential and commercial customers (collectively, the "Services").

2. Services

2.1 Scope

We provide backflow prevention assembly testing, repair, and installation in accordance with applicable Texas Commission on Environmental Quality (TCEQ) regulations, local water purveyor requirements, and applicable plumbing codes. The specific scope of any job will be described in the estimate, work order, or invoice provided to you.

2.2 Estimates and Quotes

Any estimate or quote we provide is based on the information available at the time and the conditions reasonably anticipated. If we discover additional issues, parts, or labor are required once work begins, we will make reasonable efforts to notify you and obtain your approval before performing additional billable work. Estimates are valid for 30 days unless otherwise stated.

2.3 Scheduling and Access

You agree to provide safe, clear, and timely access to the property and to the backflow assembly or work area. If we are unable to access the property at the scheduled time, or if the assembly is obstructed, you may be charged a trip or rescheduling fee of $50.00. You are responsible for ensuring water service can be temporarily shut off during testing or repair when necessary.

2.4 Regulatory Filing

Where backflow testing must be reported to a water purveyor or municipality, we will submit the required test report on your behalf unless you instruct us otherwise. You remain responsible for ensuring your assembly is tested at the frequency required by your water provider and for any penalties, fines, or water service interruptions resulting from missed deadlines outside our control.

3. Pricing and Payment

3.1 Fees

Fees for Services are as stated in your estimate, work order, or invoice. Prices are subject to change for future jobs but will not change for an accepted job except as described in Section 2.2.

3.2 Payment Terms

Payment is due on receipt, unless other arrangements are agreed in writing. We accept cash, check, Zelle, debit card, credit card, or ACH transfer.

3.3 Late Payment

Past-due balances may accrue interest at a rate of 1.5% per month, or the maximum rate permitted by Texas law, whichever is lower. You agree to pay reasonable costs of collection, including attorneys' fees, to the extent permitted by law.

3.4 Deposits

For installation or larger repair jobs, we may require a deposit before work begins. Deposit terms will be stated in your estimate.

4. Cancellations and Rescheduling

You may cancel or reschedule a scheduled appointment by contacting us at least 48 hours in advance. Cancellations made with less than 48 hours' notice, or failure to provide access at the scheduled time, may result in a cancellation fee of $50.00.

5. Warranties and Disclaimers

5.1 Workmanship Warranty

We warrant that repair and installation Services will be performed in a workmanlike manner consistent with industry standards. If a defect in our workmanship appears within 1 year of completion, we will, at our option, re-perform the affected work at no additional labor charge. This warranty does not cover:

• Parts or equipment (which carry only the manufacturer's warranty, if any);
• Damage caused by misuse, tampering, freezing, vandalism, acts of others, or normal wear;
• Pre-existing conditions or issues unrelated to our work; or
• Assemblies, piping, or components we did not install or service.

5.2 Testing Disclaimer

A backflow test reflects the condition and performance of the assembly at the time of testing only. A passing test does not guarantee future performance, and we are not responsible for failures, leaks, or backflow events occurring after the test due to changes in conditions, water pressure, freezing, tampering, or component aging.

5.3 General Disclaimer

EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE SERVICES AND THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE," AND WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TO THE FULLEST EXTENT PERMITTED BY LAW.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW:

• Our total aggregate liability arising out of or relating to the Services or these Terms shall not exceed the amount you actually paid us for the specific Service giving rise to the claim.
• We shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of water service, property damage from pre-existing conditions, business interruption, or lost profits, even if advised of the possibility of such damages.

Nothing in these Terms limits liability that cannot be limited or excluded under applicable law, including liability for gross negligence, willful misconduct, or personal injury caused by our negligence.

7. Indemnification

You agree to indemnify and hold harmless Atlas Backflow Testing and its owners, employees, and agents from any claims, damages, or expenses arising out of: (a) your breach of these Terms; (b) your failure to provide accurate information or safe property access; or (c) conditions on your property not caused by us.

8. Use of the Site

You agree not to use the Site for any unlawful purpose, to interfere with its operation, or to attempt unauthorized access to our systems. All content on the Site (text, logos, graphics) is owned by Atlas Backflow Testing or its licensors and may not be copied or reused without permission.

9. Communications

By providing your contact information, you consent to receive communications from us related to your Services (such as scheduling, confirmations, and invoices). For text message communications, separate consent terms apply — see our SMS/Text Messaging Terms and our Privacy Policy. You may opt out of marketing communications at any time.

10. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in Ellis County, Texas, and you consent to the jurisdiction of those courts.

11. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date reflects the most recent version. Continued use of the Site or our Services after changes are posted constitutes acceptance of the revised Terms.

12. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
